Mitha Singh and Co Found Guilty...

They were found guilty of waging war against India - by posting mere words on social media.

India's democratic credentials and judicial system has come into sharp focus 31st January 2019.
The long running saga of Bhai Arvinder Singh aka Mitha Singh and his two companions of having been arrested by the notorious Panjab Police over three years ago and charged with waging war against the Nation has come to an unbelievable conclusion.


Thursday afternoon the presiding judge had told the court that he required an extention of time before he felt able to serve a judgement in the case.
He then adjourned the proceedings and the defence team left the vicinity, after only half an hour the judge called the defendants via video link from their prison and pronounced them guilty of waging war against the Union States of India without their being in a court of law or having their legal representation present.
These young Sikhs have been arrested and charged under section 121 and 121(a) of the Indian Penal Code, which reads:
“Whoever wages war against the Government of India, or attempts to wage such war, or abets the waging of such war, shall be punished with death, or imprisonment for life, and shall also be liable to fine."
The Indian Constitution and international standards of human rights and decency all accept the freedom of expression and thought.
These Sikhs have been accused and pronounced guilty of having stated a desire for independence from the corrupted and morally bankrupt Union States of India, using terms like Khalistan Zindabad and more worryingly, Raj Karega Khalsa.
Sikh Relief and their legal team are already planning the appeals and are committed to fight this travesty and utter perversion of justice from the Panjab and Haryana High Court all the way to India's Supreme Court if necessary.
We appeal to all Sikhs, globally, to beware the warning of last year, that such an outcome of this case was a distinct possibility and the blatant political posturing of those more interested in their personal image as session court lawyers who undermined the dire need for public awareness of this case.
Now we are here with Sikh youths found guilty of crimes punishable by sentences of upto life in prison and even death, for raising slogans and not even a suggestion of arms.
How weak is Indian democracy when it imprisons the voice of its youth and future? Can it even be considered a democracy?
Sentencing has been scheduled for 5th February 2019 and we await that with poised anticipation and a well drafted appeal.
